A settlement agreement between rapid prototyping suppliers 3D Systems and EOS GmbH has been reached regarding all worldwide disputes and litigation between the companies.
Under terms of the settlement, 3D Systems and EOS waived all claims for damages with respect to their pending disputes and litigation, and the companies also have licensed various patents to each other. As part of the deal, EOS will pay 3D Systems certain royalties for its patent license, and 3D Systems expects to begin selling under its own brand certain laser-sintering equipment and related products produced by EOS under an OEM supply arrangement.
The new patent cross-license is in addition to the license agreement already entered into by the companies in 1997, according to EOS, and it includes certain patent rights acquired by 3D Systems from DTM Corp. and licensed to 3D Systems by the University of Texas. Under the new agreement, EOS will pay to 3D Systems a royalty based on future sales of certain laser-sintering systems in the US, and 3D Systems will purchase and sell certain laser-sintering products from EOS, such as the EOSINT P 700 large-frame laser-sintering machine.
